Acceptance of Terms. By purchasing this water testing kit, you agree to be bound by these Terms and Conditions. If you do not agree, do not complete your purchase. Completion of the checkout process constitutes your acknowledgment and acceptance of this agreement.
Nature of Services. The Company sells water sampling kits and facilitates laboratory testing performed by independent third-party certified laboratories. The Company is not a laboratory, does not perform analytical testing, and does not certify water quality. All testing is performed by an independent certified laboratory identified in your report. The Company does not provide medical, legal, environmental, engineering, or regulatory advice.
Scope of Testing and Important Disclosure. Testing is limited strictly to the specific contaminants included in the package you purchase. The test does not evaluate all possible contaminants or water conditions. Test results reflect only the specific sample submitted and the condition of that sample at the time it was collected. Results do not guarantee water safety, potability, or regulatory compliance.
Customer Sampling Responsibility. Accurate results depend on proper sample collection, handling, storage, and shipment. You are solely responsible for following all sampling instructions provided with the kit. The Company is not responsible for contamination, degradation, delay, temperature exposure, improper packaging, shipping issues, or other factors that may affect the integrity of the sample before it is received and accepted by the laboratory. Results are based solely on the sample received and analyzed by the laboratory. You acknowledge that improper collection or handling may result in inaccurate or misleading results.
Laboratory Relationship. All analytical testing is performed by an independent certified laboratory. The laboratory operates independently and is responsible for its analytical methods, procedures, and results. The Company is not responsible for laboratory errors or delays.
No Medical, Health, or Regulatory Advice. Test results are provided for informational purposes only. They are not medical advice and do not diagnose any health condition. You should consult appropriate professionals regarding health, plumbing, or regulatory concerns.
No Guarantee of Safety or Fitness. The Company makes no representation or warranty that any water source is safe, potable, suitable for consumption, or compliant with regulations. Decisions made based on test results are solely your responsibility.
Refund Policy. Kits may be returned for a refund only if unused and unopened within the time period stated on the Company’s website at the time of purchase. Once a sample has been submitted to the laboratory for analysis, the service is considered performed and is non-refundable. Shipping charges are non-refundable unless otherwise required by law.
LIMITATION OF LIABILITY. TO THE FULLEST EXTENT PERMITTED BY LAW, THE COMPANY’S TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT PAID FOR THE KIT. THE COMPANY SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, EXEMPLARY, OR PUNITIVE DAMAGES, INCLUDING PERSONAL INJURY, PROPERTY DAMAGE, DIMINUTION IN PROPERTY VALUE, LOST PROFITS, BUSINESS INTERRUPTION, REAL ESTATE IMPACTS, OR REGULATORY PENALTIES. YOU ACCEPT ALL RISK ASSOCIATED WITH DECISIONS MADE BASED ON TEST RESULTS.
Indemnification. You agree to indemnify and hold the Company harmless from claims arising out of improper sample collection, misuse or misinterpretation of results, or reliance beyond the stated scope of testing.
Governing Law and Dispute Resolution. These Terms shall be governed by and construed in accordance with the laws of the State of Indiana, without regard to its conflict of law principles. Any dispute arising out of or relating to these Terms or the purchase or use of the kit shall be brought exclusively in the state courts located in Hamilton County, Indiana, or, if federal jurisdiction exists, in the United States District Court for the Southern District of Indiana. You consent to the personal jurisdiction of such courts and waive any objection to venue in those courts. TO THE FULLEST EXTENT PERMITTED BY LAW, YOU AND THE COMPANY WAIVE ANY RIGHT TO A TRIAL BY JURY. Any claim must be brought solely in your individual capacity and not as part of any class or representative proceeding.
Severability. If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions shall remain in full force and effect.
Entire Agreement. These Terms constitute the entire agreement between you and the Company regarding the kit and supersede any prior statements or agreements relating to the subject matter.
